Private Caucases

Any meetings out of the presence of adverse parties (caucuses) shall be considered private and information shall be disclosed to adverse parties only with the consent of the parties and their counsel. In court sponsored mediations, the mediator will file a Statement of Agreement/ Nonagreement with the court indicating that the mediation has been conducted and whether the dispute has been settled in whole or part.

Briefs:

The filing of briefs will be optional. Any briefs may be filed on a confidential basis, but should be marked as such in the caption.

No Legal Services:

The mediator will serve as a neutral intermediary to facilitate communication, constructive negotiation and settlement of this matter. The mediator shall not represent or advocate the position of any party. Statements by the mediator, even regarding legal issues, do not constitute legal advice, but are mere statements of personal opinion. Any help by the mediator in the preparation of a settlement agreement (including the use of the Mediator's agreement forms) will not constitute legal advice. Any settlement agreement should be independently reviewed and approved by counsel and the parties.

Conflicts Disclosure:

The parties will be provided with a scheduling letter containing detailed billing information and with a "conflicts disclosure under the standards of California law under California Rule of Court 1620, et seq." The mediator invites any questions about the disclosure or any other questions that a party or counsel may have about his personal, professional or financial relationships with any party or counsel.

Mediations:

The rate for services is $295/ hour, including hearings, travel and study time. Mediations are customarily scheduled for one-half day $1,180 or full day at $2,360. Any costs of travel or lodging will be in addition to the hourly rate. To reserve a mediation date, please contact The Page Firm for prospective dates and to arrange reservation deposits. A scheduling letter will constitute confirmation of the date, subject to timely receipt of a reservation deposit. Deposits will become nonrefundable if a reserved date is cancelled less than fourteen (14) days in advance.

Arbitrations:

Arbitrations are ordinarily administered by the American Arbitration Association ("AAA")(877.528.0880) or its International Centre for Dispute Resolution ("ICDR")(212.484.4181). Mr. Page will serve as an arbitrator for other institutions or ad hoc upon written invitation by another institutional provider or by the parties or their counsel.

To schedule arbitration services, please contact the AAA, the ICDR or The Page Firm to arrange for administrative services, including a preliminary hearing. A scheduling letter will constitute confirmation of any dates, subject to timely receipt of a reservation deposit. Deposits will become nonrefundable if a reserved date is cancelled less than fourteen (14) days in advance.

Other Services:

Other services such as discovery master, fact finding, special master, private judging, partnering or mini trials are also available at similar rates. Proceedings may be conducted in English or Spanish.
